Civilian oversight of law enforcement misconduct didn’t always exist. From 1930’s to 1960’s riots over race relations and violence had to occur in order to obtain accountability and civilian complaint process. Its sad to see in previous decades there was no system that made the community voice their opinions. Currently we have so many resources that can be beneficial to obtain fairness and equality within law enforcement. There are body worn cameras that can assist in investigations, complaint forms that can be filled out from the comfort of our homes, we can always take a case to court and explain our reasoning of why the case was unjust and many more. The first positive aspect of civilian oversight of police misconduct I have chosen is enhanced t transparency by offering a third-party opinion on police misbehavior cases, civilian oversight investigations work to increase transparency. Since it shows an obligation to transparency and accountability, this promotes trust between the community and law enforcement. Some examples of this may be auditing within an agency by an auditing company that takes accountability in assessing agencies policies and procedures to make sure they are doing what they are supposed to do .The second positive civilian oversight is Community Engagement through the process of civilian oversight investigations, members of the community are provided with the opportunity to voice their concerns and offer recommendations. Through fostering a sense of involvement and participation, this engagement helps ensure that the investigation demonstrates the needs and ideas of the affected community. Lastly, I have chosen more objectivity , individuals with a wide range of experiences and backgrounds frequently make up civilian management bodies. This diversity may minimize any possible prejudices within law enforcement agencies and assists in providing a more neutral evaluation of cases that involve police misconduct. The most significant advantage of civilian oversight is increased transparency. Transparency is essential for accountability and the restoration of public trust in law enforcement. Civilian oversight bodies ensure that the findings and outcomes of misconduct cases are accessible to the public by conducting investigations in a transparent manner. This transparency helps to hold both individual officers and law enforcement agencies accountable for their actions, promoting a culture of responsibility and respect in the long run. The first negative aspect of civilian oversight of misconduct is lack of expertise. Members of civilian oversight boards might not have the specialized expertise and knowledge required to fully understand the complexities of law enforcement procedures. This can make it difficult to accurately assess the conditions surrounding an incident, potentially resulting in wrong conclusions or recommendations. Civilians don’t experience the daily concern a law enforcement may face for example fear of being killed by a subject that may justify the reasoning of an open case. Sometimes there are factors that law enforcement officers must consider that may require them to take drastic decisions. The second negative aspect I have chosen is political interference Civilian monitoring committees are prone to political incentives, which can lead to improper decision-making. Political agendas or opinions of the public might influence the board's decisions, jeopardizing the investigation's unfairly and possibly harming the objective of justice. It is not fair to be bribed by government agencies and punish someone or an agency that wants to bring justice. We have to remember that elected officials will do absolutely everything in their power to influence the people and this can be in a negative way or positive way. Lastly would be Funding and Resources, Civilian Personnel oversighting organizations may face challenges with gathering sufficient funding and resources for performing thorough investigations. Insufficient funds may restrict their ability to conduct thorough inquiries, which causes delays or unsuitable monitoring of misconduct cases. The most serious disadvantage is a lack of expertise. A significant challenge is a scarcity of knowledge among civilian oversight members of boards. It is hard to correctly evaluate every aspect of a case without an in-depth comprehension of law enforcement procedures. This can lead to incorrect conclusions, which could threaten the oversight process's credibility. To address this, adequate training and resources must be provided to civilian staff members, ensuring they have the knowledge required to make informed decisions during investigations.
