Those Cherokee that refused to honor their removal treaty with the United states of America voluntarily, were forced by the army to vacate their lands. 23rd of may in the year 1838 was the deadline for voluntary removal and as the deadline expired the army under General Winfield Scott along with 7000 soldiers forcibly removed the Cherokee.
