Congress can't make a law respecting an establishment of religion, or prohibiting the free exercise of, or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Businesses that produce information like news stations, book companies, newspapers, magazine companies, etc. if it has the ability to sway a reader or watcher's opinion or belief. it is protected. A lot of times for the better but there are times where even negative hate speech is protected by the first amendment.
