Justice Roberts reviewed common laws, colonial laws, and early state laws. He discovered that these laws could be reasonably interpreted to allow or permit a defendant to obtain counsel. However, he concluded that they could not serve as a precedent β€œto compel the state to provide counsel for a defendant. Thus, providing state appointed counsel is an option not a requirement.
