the 8th amendment was written to preserve people's right to life, liberty and the pursuit of happiness.

The Eight Amendment was included after the Constitution was ratified. It was added was because many thought the Constitution initially made the government too powerful and it allowed the Congress create Federal crimes and punish those who committed those crimes, because of that, many thought it could be used as a tool to opress the population.
