I finally have the trial (and I really did steal the mac n’ cheese). However, there is not enough evidence to convict me and I am freed. Three weeks later, the store owner realizes that he has a security videotape that clearly shows me stealing the cheese.

Will I be retried, given that there is new evidence against me?

What amendment answers this?

No

The 5th amendment, known as "Double Jeopardy", states that you are not able to be tried for the same crime twice.
