"excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted" this was adopted on December 15 1791. so an example if someone were to strangle someone they can't be strangled. so they can have the same inflicted murder as the person who was wronged. and if they were to have tempted murder they shouldn't be killed or have life depending. and if there is a sign of mental illness they must be treated for it and not as a welled minded person with I'll intentions. and for the unusual punishments like the judge and juries cant make up their own punishment. it has to be probation, jail, prison, ect, and in some states the death penalty.
