Affirmative action goes against the constitution is the argument critics make because they it would go against Amendment 14 which makes everyone equal under the law. This answer is more correct however affirmative action is a form of gender discrimination could also be an answer because affirmative actions benefits women and minority groups. Hope this helps :)
