Since the 1865 Constitution was obviously less fair how did it get passed?

Passed on by congress on January ,31st ,1865, and ratified on December ,6th, 1865 ,the 13th amendment abolished slavery in the US and provide that neither slavery nor involuntary servitude , except as punishment of crime whereof the party shall have been duly convicted ,shall exist within the US or any place subject to their jurisdiction .
