When filing a section 1983 complaint, you file someone when their civil rights have been violated.

Basically after filing a section 1983 complaint you can sue the state government and local government officials. This includes police officers who used excessive force, unlawful searches/seizures and or violated an individuals due process of equal protection rights. (You can also file against prison officials, probation officers, and elected officials)

After you file, it can be taken to state court (lower courts). However monetary damages is reduced.

When obtained, you can receive compensation “compensatory damages”.

(It’s a compensation for any harm or injury you sustained as a result of the governments officials actions. Damages that may affect you under this section is:

Medical expenses, lost wages, pain and stuffing, and emotional distress. )
