Still busy with your investigation on the theft charges against Mr Long Fingers, you want to proof that a reply to the bank, confirming the deposit of the money, was in the handwriting of the accused. You interviewed a colleague of the suspect, mrs Diligent, who worked with him for five years. She told you that she had for the last ten years, and quite apart from her normal work, given considerable study and attention to handwriting. She had on several occasions professionally compared handwritings but had never given evidence on handwriting. How will you go about getting the evidence of this witness (Mrs Diligent), to be admissible? (10)

To get the evidence of Mrs Diligent to be admissible, you will need to establish her expertise in the field of handwriting analysis. This can be done by questioning her about her qualifications and experience, and by asking her to provide examples of her previous work in the field. You may also want to consider having her undergo a handwriting analysis test to demonstrate her skills and proficiency. Once you have established her expertise, her evidence may be admissible under the rules of evidence. However, it will ultimately be up to the judge to decide whether her evidence is admissible, based on the specific circumstances of the case.
