The reason why I believe so is because the case of Brown v. Board of Education had to do with inequality. They weren't allowing black kids to go to schools were white kids went(segregation). Which means that they deny equal protection. They argued that "separate but equal" wasn't actually equal. Just for the fact that they are separating them, it's not equal.
