The US Supreme Court ruled that the recount ordered by the Florida Supreme Court was unconstitutional. The court based this decision on the equal protection clause of the 14th Amendment. It ruled that recounting only the votes rejected by machine in only four counties gave preferential treatment to certain votes in an arbitrary way, violating the equal treatment of all people in the state, and in this case, their right to vote.

The ruling of the Supreme Court was in Bush's favor. Although some irregularities were found, there simply wasn't enough time to fix them. This led to Bush becoming the president due to the electoral votes won from Florida.
