The Supreme Court reinterpreted the Article 1, Section 8, Clause 3 of the U.S. Constitution refers to Commerce clause, which gives Congress the power to control commerce among with the several states, the Indian tribes and foreign nations changing it from a check on national power to a source of national power in 1937.
