The statement above is FALSE. Deviation from the required performance pertaining to a contact is said to be NON-MATERIAL when the deviation does not result in a substantial change in the value of the contract while the deviation is considered material when it results in substantial change in the value of the contract. The innocent party is entitled to collection of damages.
