Pretrial detention is an incarceration that is allegedly justified for non-punitive purposes.

Punitive purposes consist of an unpleasant imposition may include a fine, sanction or confinement

While the preventive, is a form of detention, is the detention of suspects, which in the United States allows the power to detain citizens indefinitely.

By this means, Congress and the individual states enacted the policies that allow the indefinite detention without trial of the suspects of US terrorism arrested in US territory that could then be sent to Guantanamo Bay, in order to avoid greater evils.
