With Marbury v. Madison, the Supreme Court asserted their right of judicial review.

Judicial review refers to the Courts ability to review actions of the legislative and executive brach to determine whether or not they are constitutionally permissible.

This is one of the ways that the Judicial Branch acts as a check on the legislative and the executive branches.
