Why did U.S. government officials described the war as an "invasion" of South Vietnam by North Vietnam

The use of the word "invasion" matters for the purpose of international law.

If the Northern Vietnamese army invaded the South, the US could reasonably come to the South's aid.

If it wasn't an invasion, than the US was just meddling.
